1. Acceptance of Terms

By accessing and using formblends.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Platform or services. These Terms constitute a legally binding agreement between you and FormBlends.

2. Platform Description and Limitations

FormBlends operates an informational and marketing platform that helps users learn about GLP-1 and related treatment options and begin the process of connecting with independent licensed healthcare providers and pharmacy services. Certain services referenced on formblends.com may be completed through FormScripts.com.

FormBlends is not a healthcare provider. FormBlends does not practice medicine, provide medical advice, or make clinical decisions. All medical services, including diagnosis, treatment recommendations, and prescribing decisions, are provided by independent, licensed healthcare providers who exercise their own professional judgment.

Your use of the Platform does not create a patient-provider relationship between you and FormBlends. Any patient-provider relationship is solely between you and the healthcare provider you consult with through the Platform. Website content, including articles, product descriptions, and educational resources, is provided for informational and educational purposes only and does not constitute medical advice.

3. Redirected Services and Third-Party Platforms

FormBlends.com may include links, forms, buttons, or calls to action that direct users to FormScripts.com for consultation, prescribing, payment, or fulfillment. FormBlends does not itself provide medical care, make prescribing decisions, process prescription transactions, or dispense medications. 4. Telehealth Services

Our Platform facilitates telehealth consultations, which involve the delivery of healthcare services using electronic communications between a healthcare provider and a patient who are not in the same physical location. By using our telehealth services, you acknowledge and agree to the terms in our Consent to Telehealth page.

Telehealth services are currently available to individuals located in select US states. You are responsible for verifying that services are available in your state and for accurately reporting your location when accessing services. Providing false location information may result in termination of services and may violate state and federal law.

Telehealth services are not a substitute for in-person care in all cases. Your healthcare provider may determine that telehealth is not appropriate for your condition and may refer you to in-person care. Telehealth services are not an emergency or on-call service.

5. Compounded Medications

Certain medications available through the Platform are compounded medications prepared by FDA-registered 503B outsourcing facilities. You acknowledge and understand the following:

  • Compounded medications are not FDA-approved as finished products.
  • Compounded medications have not been evaluated by the FDA for safety, effectiveness, or quality.
  • Compounded medications are not the same as commercially available FDA-approved branded medications, even when they contain similar active ingredients.
  • Compounded medications are not generic drugs. They are custom-prepared by licensed pharmacies.
  • The decision to prescribe a compounded medication is made by your licensed healthcare provider based on their independent medical judgment and your individual clinical needs.
  • Compounded medications are typically not covered by insurance.
  • You may receive medication that looks different from images shown on the Platform.

6. Eligibility

You must be at least 18 years of age and located in an eligible US state to use our services. By using the Platform, you represent that you are at least 18 years old and that the information you provide, including your identity, location, and medical history, is accurate and complete. If you do not qualify for a prescription after your medical evaluation, we will refund your payment.

7. Your Obligations

You agree to provide complete and accurate medical history and health information during your consultation. You agree to promptly inform your healthcare provider of any changes in your health status, medications, or adverse reactions. You agree to follow your prescribed treatment plan and attend recommended follow-up appointments. You understand that failure to provide accurate information may result in adverse health outcomes for which FormBlends bears no responsibility.

8. Orders, Payment, and Pricing

Certain services or purchases referenced on the Platform may continue on FormScripts.com. Any resulting orders are subject to acceptance, provider approval, and availability. Prices are listed in US dollars and are subject to change. Additional purchase terms may apply on the site where your transaction is completed.

9. Shipping and Delivery

If your order continues through FormScripts.com or an affiliated fulfillment workflow, shipping availability, timing, and costs will be disclosed during the applicable checkout or order process. Additional details are outlined on our shipping policy page.

10. Returns and Refunds

Due to the nature of prescription medications, returns of dispensed medications are not accepted per state and federal regulations. Eligibility-related refunds and non-prescription refund terms, where applicable, are detailed on our returns policy page.

11. Intellectual Property

All content on this website, including text, images, logos, and design, is the property of FormBlends and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FORMBLENDS MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE PLATFORM. FORMBLENDS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. FORMBLENDS DOES NOT GUARANTEE ANY SPECIFIC MEDICAL OUTCOME OR RESULT FROM USE OF OUR SERVICES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMBLENDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE TOTAL AMOUNTS PAID BY YOU TO FORMBLENDS IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

14. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of our Platform or services shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in the State of Delaware, or at another mutually agreed location. The arbitrator's decision shall be final and binding.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

You may opt out of this arbitration provision by sending written notice to support@formblends.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts of the State of Delaware.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provision above.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated revision date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
